2.1 Available Membership Plans

Color Theory Education, LLC offers two monthly membership plans.

Individual Membership — $8.99/month

Provides one registered user with access to the three ICS educational applications: Elementary Color Wheel, Universal Color Wheel, and Nopia Color Wheel.

Individual Memberships are intended for personal educational use and may not be shared with other individuals.

Classroom Membership — $49.90/month

Provides access for up to 10 registered users, including one account owner and nine invited members.

The account owner, typically a teacher or educator, manages classroom invitations and membership access.

Classroom Memberships may include authorized students, teachers, or other educational participants from different grade levels, subject to the membership's user limit.

2.2 Account Registration

Members must provide accurate registration information and maintain a valid email address associated with their accounts.

Each registered member is responsible for maintaining the confidentiality of their login credentials.

Membership accounts may not be sold, transferred, or shared with unauthorized individuals.

2.3 Account Security

Members are responsible for taking reasonable precautions to protect their account information.

Members should not disclose their passwords or allow unauthorized individuals to access the educational applications using their credentials.

If unauthorized account access is suspected, members should change their passwords promptly and contact Color Theory Education, LLC at contact@colortheoryeducation.com.

2.4 Classroom Account Owners

Classroom Membership account owners are responsible for managing their invited users and maintaining compliance with the membership's 10-user limit.

Account owners may invite authorized students or educators, remove members who no longer require access, and reassign available membership seats.

Each invited member must use their own authorized account.

2.5 Student Accounts and Supervision

Teachers, schools, and classroom account owners are responsible for supervising student use of the ICS educational applications according to applicable school policies.

For younger students, account registration and access must comply with applicable parental authorization requirements and student privacy obligations.

Classroom account owners should ensure that student accounts are created and managed appropriately.

2.6 Unauthorized Use

Members may not:

  • Share login credentials with unauthorized individuals.

  • Attempt to bypass membership restrictions or security measures.

  • Resell, sublicense, or commercially distribute membership access without written authorization.

  • Use another member's account without permission.

  • Interfere with the operation or security of the ICS educational applications.

Color Theory Education, LLC reserves the right to investigate suspected misuse and suspend or terminate membership access when necessary, subject to applicable law.

2.7 Membership Access and Updates

Active members receive access to the educational applications included in their subscription plan.

Application improvements, corrections, and updates may be introduced periodically without requiring members to download or reinstall the applications.

Features and functionality may change as the educational applications continue to develop.

Section 3 — Free Trials, Payments, and Automatic Renewals

3.1 Seven-Day Free Trial

Color Theory Education, LLC may offer eligible new members a seven-day free trial to explore the ICS educational applications before beginning a paid subscription.

Free-trial availability, eligibility, and included features are determined by the membership offer presented during registration.

A free trial may be limited to one trial per eligible user or account, as specified in the applicable offer.

3.2 Free-Trial Expiration and Customer Responsibility

Members are responsible for keeping track of their free-trial expiration date.

If a free trial includes automatic conversion to a paid subscription, the selected membership will begin billing at the end of the trial unless canceled before the applicable deadline.

Color Theory Education, LLC does not independently provide reminders before a free trial expires.

Members should not rely on receiving an expiration reminder and should review the billing information provided during registration.

This provision does not limit any notifications required by applicable law or sent by our payment or membership service providers.

3.3 Monthly Membership Fees

The current standard monthly membership fees are:

Individual Membership: $8.99 per month for one registered user.

Classroom Membership: $49.90 per month for up to 10 registered users, including the account owner.

Any applicable taxes or additional charges will be disclosed during checkout.

Special institutional pricing, promotional offers, or school district discounts may be available through separate arrangements.

3.4 Automatic Subscription Renewal

Paid memberships renew automatically each month unless canceled before the next renewal.

By enrolling in a recurring paid membership, members authorize the applicable recurring charges according to the subscription terms disclosed at checkout.

The membership fee is charged using the payment method associated with the member's account.

Members are responsible for reviewing their subscription information and canceling before the next billing date if they do not wish to renew.

3.5 Payment Processing

Membership payments are processed through Stripe, our third-party payment processor.

Color Theory Education, LLC does not directly store complete credit or debit card numbers.

Members are responsible for providing valid payment information and maintaining an authorized payment method.

3.6 Failed or Declined Payments

If a subscription payment is declined or cannot be processed, membership access may be interrupted or restricted until the payment issue is resolved.

Members should review and update their payment information through the available membership management options.

Color Theory Education, LLC is not responsible for charges imposed independently by a member's financial institution.

3.7 Changes to Membership Pricing

Color Theory Education, LLC reserves the right to modify membership pricing for future subscriptions or renewals.

Any pricing changes affecting existing recurring subscriptions will be communicated in advance when required by applicable law.

Members may cancel their subscriptions before a new price takes effect if they do not wish to continue at the revised rate.

3.8 Billing Questions and Assistance

Members who have questions about subscription charges, payment processing, or membership billing may contact:

Color Theory Education, LLC

Email: contact@colortheoryeducation.com

Website: colortheoryeducation.com

Section 4 — Cancellations, Refunds, and Membership Changes

4.1 Membership Cancellation

Members may cancel their Individual or Classroom Membership at any time.

Cancellation may be completed through the available membership or subscription management options. Members who need assistance may contact Color Theory Education, LLC at contact@colortheoryeducation.com or through colortheoryeducation.com.

Members are responsible for ensuring that cancellation is completed before their next scheduled billing date to avoid an additional subscription charge.

4.2 Access After Cancellation

When a paid membership is canceled, access to the ICS educational applications will ordinarily remain available until the end of the current paid billing period.

After the paid membership period expires, access to the applications will end unless the membership is renewed or reactivated.

For Classroom Memberships, expiration of the account owner's subscription also ends access for invited members associated with that subscription.

4.3 Refund Policy

All membership payments are generally non-refundable.

Because the ICS educational applications provide digital access upon membership activation, Color Theory Education, LLC does not ordinarily issue refunds for:

  • Unused membership time.

  • Early cancellation of a subscription.

  • Failure to access or use the educational applications.

  • Changes in personal circumstances or educational needs.

  • Failure to cancel before a scheduled renewal.

Refunds or other remedies will be provided where required by applicable law. Any additional exceptions are at the discretion of Color Theory Education, LLC.

4.4 Free-Trial Cancellation

Members who do not wish to continue with a paid membership must cancel their free trial before the applicable expiration deadline.

If the trial includes automatic conversion to a paid subscription, failure to cancel before that deadline may result in the first recurring membership charge.

Color Theory Education, LLC does not independently send free-trial expiration reminders. Members are responsible for reviewing their trial dates and cancellation requirements.

Any legally required notices remain applicable.

4.5 Membership Upgrades and Changes

Members may request a change from an Individual Membership to a Classroom Membership or inquire about other available membership arrangements.

The Individual Membership provides access for one registered user at $8.99 per month.

The Classroom Membership provides access for up to 10 registered users at $49.90 per month.

Membership changes are not guaranteed to occur automatically. Members should review their existing subscription before activating a different plan to avoid overlapping charges.

Any applicable billing adjustments, effective dates, or additional payments will be determined by the membership change process and communicated to the member.

For assistance, contact contact@colortheoryeducation.com.

4.6 Failed Cancellation Attempts or Billing Concerns

Members experiencing technical difficulties when attempting to cancel a subscription should contact Color Theory Education, LLC promptly, preferably before the next billing date.

Members should retain any available confirmation of their cancellation request.

Billing concerns will be reviewed according to the applicable membership terms and legal requirements.

4.7 Suspension or Termination for Misuse

Color Theory Education, LLC reserves the right to suspend or terminate membership access when a member materially violates these Terms & Conditions, including unauthorized account sharing, fraudulent activity, or attempts to bypass application security.

Where appropriate, members may be notified of the issue and given an opportunity to resolve it.

Any refund or remaining access rights following suspension or termination will be determined according to applicable law and the circumstances of the violation.

Section 5 — Classroom Memberships, Student Access, and District Licensing

5.1 Classroom Membership Structure

The ICS Classroom Membership provides access to all three educational applications for $49.90 per month, accommodating up to 10 registered users, including one account owner and nine invited members.

The account owner, typically a teacher or educator, is responsible for managing invitations, membership seats, and authorized access.

Each invited member must maintain an individual account.

5.2 Invitations, Cross-Grade Collaboration, and Account Owner Authority

Classroom Membership invitations are not restricted to students or educators within the same classroom, school, or grade level.

For example, an elementary school teacher may invite a high school art teacher, or vice versa, allowing educators to share educational resources appropriate to different ages and learning levels.

The Classroom Membership account owner retains exclusive administrative control over the membership.

The account owner has the authority to:

  • Invite authorized teachers, students, or other educational participants.

  • Grant or revoke membership access.

  • Remove invited members and reassign available membership seats.

  • Manage the membership subscription, including changes and cancellation.

  • Determine which authorized participants may use the available membership seats.

Invited teachers are members, not account owners or administrators. They may use the educational applications within the permissions granted by the account owner, but they may not:

  • Invite additional members.

  • Remove or replace existing members.

  • Cancel, modify, or upgrade the Classroom Membership.

  • Change subscription billing arrangements.

  • Assume administrative authority or make membership-management decisions on behalf of the account owner.

All invited members count toward the Classroom Membership's 10-user limit.

An invitation grants access to the educational applications only. It does not transfer membership ownership or administrative rights.

5.3 Managing and Reassigning Membership Seats

Classroom account owners may manage authorized members through the membership account's Team management features.

Account owners may remove members who no longer require access and invite new authorized users to occupy available seats.

Removing a member ends that member's access through the Classroom Membership.

Membership seats may not be sold, sublicensed, or transferred for unauthorized commercial purposes.

5.4 Classroom Account Owner Responsibilities

Classroom account owners are responsible for:

  • Inviting only authorized participants.

  • Maintaining the membership's maximum user limit.

  • Removing users who no longer require access.

  • Protecting membership invitation links from unauthorized distribution.

  • Ensuring appropriate supervision of student accounts.

  • Following applicable school policies and privacy requirements.

Color Theory Education, LLC may restrict access when membership privileges are misused or unauthorized users are identified, subject to applicable law.

5.5 Student Registration and Privacy

Teachers, schools, and educational institutions are responsible for ensuring that student registration and access comply with applicable school policies and legal requirements.

For younger students, account creation and use must follow applicable parental consent, school authorization, and student privacy requirements.

Student accounts should be managed by authorized adults when appropriate.

Additional information about the collection and handling of personal information will be provided in the Color Theory Education, LLC Privacy Policy.

5.6 School and District Licensing

Schools, school districts, and educational institutions interested in providing ICS educational applications to multiple classrooms may request institutional licensing arrangements.

Special discounts may be available for larger schools and school districts based on the number of classrooms, teachers, students, and membership seats requested.

Institutional pricing, membership allocation, payment arrangements, and access conditions will be established through a separate agreement when applicable.

Special district pricing is not automatically included in standard Individual or Classroom Membership subscriptions.

5.7 Institutional Account Administration

For school or district licensing arrangements, Color Theory Education, LLC may coordinate with authorized school administrators to establish membership access for participating teachers or classrooms.

Each designated Classroom Membership account owner is responsible for managing their assigned users unless a separate institutional agreement establishes different administrative arrangements.

District-wide administration, centralized reporting, or additional account-management capabilities are not included unless expressly provided in the applicable agreement.

5.8 Educational Use and Membership Limitations

Classroom Memberships are intended for authorized educational use.

Teachers may use the applications during classroom instruction, demonstrations, and supervised educational activities.

Membership access does not grant permission to reproduce, redistribute, resell, or commercially exploit the underlying applications, source code, illustrations, proprietary color systems, or other protected materials.

Authorized educational use remains subject to the intellectual property provisions of these Terms & Conditions.

5.9 Classroom Membership Expiration

If a Classroom Membership is canceled, authorized users may ordinarily continue accessing the applications until the end of the current paid billing period.

When the membership expires, access ends for both the account owner and invited members associated with that subscription.

Reactivation or enrollment in a new membership may be required to restore access.

Section 7 — Educational Purpose, NopiaLens™, and Medical Disclaimer

7.1 Educational Purpose

The Inclusive Color System (ICS) and its educational applications are designed to support color education, artistic exploration, and understanding of color perception.

The applications provide interactive learning opportunities for students, educators, artists, designers, and other interested individuals.

The educational content is intended to supplement classroom instruction, personal learning, and creative exploration.

It is not intended to replace professional instruction, individualized educational assessment, or specialized assistance when required.

7.2 Color Vision Deficiency Education

The Nopia Color Wheel and NopiaLens™ are designed to promote educational awareness of color vision deficiency (CVD) and differences in color perception.

The applications provide opportunities to explore simulated color appearances associated with:

  • Protanopia.

  • Deuteranopia.

  • Tritanopia.

  • Achromatopsia.

These educational resources are intended to encourage understanding, awareness, and consideration of different color perception experiences.

7.3 Limitations of Color Vision Simulations

NopiaLens™ provides computer-generated simulations intended to illustrate possible differences in color appearance.

The simulations do not represent an exact or universal reproduction of how every individual with color vision deficiency perceives colors.

Individual color perception may vary, including among people with the same type of color vision deficiency.

Simulation results may also be influenced by display characteristics, device settings, and the images being examined.

Users should interpret the simulations as educational illustrations rather than definitive representations of another person's visual experience.

7.4 Medical and Diagnostic Disclaimer

The Nopia Color Wheel, NopiaLens™, and other ICS educational applications are not medical devices or diagnostic instruments.

They are not intended to diagnose, screen for, treat, prevent, or determine the severity of color vision deficiency or any other medical condition.

The educational applications do not replace professional vision examinations, clinical testing, or medical advice.

Individuals seeking evaluation or diagnosis of a possible color vision deficiency should consult a qualified eye care professional.

7.5 Educational Interpretation and Individual Differences

Color perception is not identical for every individual.

The Inclusive Color System encourages educators and students to recognize that individuals may experience and interpret colors differently.

Teachers should use professional judgment when selecting instructional activities and should avoid treating simulated color appearances as definitive evidence of an individual student's visual capabilities.

7.6 Accessibility and Inclusive Learning

Color Theory Education, LLC seeks to support inclusive educational experiences through its color education resources.

However, the availability of educational tools addressing color vision deficiency does not guarantee that every application, feature, or activity will be suitable or accessible for every individual.

Teachers, schools, and other users are responsible for determining whether the applications meet their specific instructional and accessibility needs.

Color Theory Education, LLC welcomes feedback concerning usability and accessibility.

7.7 Professional and Institutional Use

Educators, researchers, and institutions may use the ICS educational applications within the permissions granted by their membership or applicable licensing agreement.

The applications should not be represented as clinically validated diagnostic tools or used to make medical determinations.

Research involving human participants, medical evaluation, or formal assessment may require additional permissions, ethical review, or independent validation.

Section 8 — Availability, Technical Requirements, and Updates

8.1 Web-Based Educational Applications

The Inclusive Color System (ICS) educational applications are provided through internet-based services.

Members may access the applications through compatible web browsers on supported computers, tablets, and smartphones.

The applications do not ordinarily require separate software installation.

8.2 Internet Connection and Device Requirements

Members are responsible for providing and maintaining the internet connection, compatible devices, and browser software necessary to access the educational applications.

Application performance may vary depending on device capabilities, operating systems, browser versions, internet connection quality, and device settings.

Color Theory Education, LLC cannot guarantee identical performance across all devices or browsers.

8.3 Service Availability and Internet Connectivity

Color Theory Education, LLC makes reasonable efforts to maintain access to its educational applications. However, uninterrupted or error-free service cannot be guaranteed.

Temporary interruptions may occur because of maintenance, technical difficulties, internet connectivity problems, hosting services, or other circumstances affecting application availability.

Members are responsible for obtaining and maintaining a reliable internet connection necessary to access the ICS educational applications.

Color Theory Education, LLC is not responsible for service interruptions, slow performance, or inability to access the applications resulting from a member's inadequate internet connection, internet service provider outages, network restrictions, or complete lack of internet access.

Membership fees are not refundable solely because a member experiences poor internet connectivity or has no internet connection, except where a refund or other remedy is required by applicable law.

This provision does not exclude responsibility for service failures attributable to Color Theory Education, LLC or any consumer rights that cannot legally be waived.

8.4 Application Maintenance and Automatic Updates

Color Theory Education, LLC may periodically introduce updates, improvements, corrections, security enhancements, and new educational features.

Because the ICS educational applications are web-based, updates may become available automatically without requiring members to download or reinstall the applications.

Features, interfaces, and functionality may be modified as the educational applications continue to develop.

8.5 Third-Party Technology and Services

The ICS educational applications and membership services may rely on third-party technology providers, including website hosting, membership management, and payment processing services.

Temporary interruptions or technical issues involving these providers may affect application access, account management, or payment processing.

Color Theory Education, LLC is not responsible for the independent operation or policies of third-party providers, except as required by applicable law.

8.6 Technical Troubleshooting

Members experiencing difficulties accessing an educational application should first check their internet connection and refresh their browser.

If the problem continues, members are encouraged to try an updated browser or a different compatible device.

If the application works correctly on another device, the issue may be associated with the original device, browser, or its settings rather than the application itself.

Members experiencing persistent problems should contact Color Theory Education, LLC and provide relevant information about the application, device, browser, and problem encountered.

8.7 Temporary Suspension for Maintenance or Security

Color Theory Education, LLC may temporarily restrict access to an educational application or membership service when reasonably necessary for maintenance, security, technical repairs, or protection against unauthorized activity.

Reasonable efforts will be made to restore affected services as soon as practical.

Any rights or remedies required by applicable law remain unaffected.

8.8 Changes or Discontinuation of Services

Color Theory Education, LLC may modify, replace, or discontinue application features or services as educational and technological needs evolve.

When a material change substantially affects an active paid membership, appropriate notice or remedies will be provided as required by applicable law.

8.9 Technical Support and Contact Information

Members requiring assistance with application access, login difficulties, or technical problems may contact:

Color Theory Education, LLC

Email: contact@colortheoryeducation.com

Website: colortheoryeducation.com

When requesting technical assistance, members are encouraged to identify the application involved and describe the problem, including the device and browser being used.

Section 9 — Privacy, Data Protection, and Children's Information

9.1 Privacy Policy

Color Theory Education, LLC respects the privacy of individuals using its websites, educational applications, and membership services.

The collection, use, disclosure, and protection of personal information are described in our separate Privacy Policy.

Members are encouraged to review the Privacy Policy before registering for a membership or providing personal information.

9.2 Membership Information

Creating and maintaining an ICS membership may require personal information, including a member's name, email address, account credentials, subscription details, and other information necessary to provide membership services.

Members are responsible for providing accurate registration information and maintaining appropriate security over their accounts.

9.3 Third-Party Technology and Service Providers

Color Theory Education, LLC makes every reasonable effort to maintain its educational applications at a high level of performance, reliability, and functionality.

To deliver our applications successfully to members' devices, we rely on specialized technology companies that provide professional hosting, membership management, security, and payment-processing services.

These providers contribute their technology and expertise to support the reliable operation of our educational applications and membership services.

Our principal service providers include:

Memberstack: Membership registration, authentication, account access, and subscription management.

Stripe: Secure payment processing, recurring subscription billing, and payment-related services.

Netlify: Website hosting and delivery of our web-based educational applications.

Although Color Theory Education, LLC strives to provide a dependable educational experience, the performance and availability of these third-party services may affect application access and functionality.

These providers may process information necessary to deliver their respective services, subject to applicable agreements, privacy requirements, and legal obligations.

9.4 Payment Information

Payments are processed through Stripe.

Color Theory Education, LLC does not directly store complete credit or debit card numbers.

Payment-related information may be processed and retained by Stripe according to its applicable policies and legal obligations.

9.5 Children's Information and Educational Accounts

ICS educational applications may be used in classrooms that include children and younger students.

Teachers, schools, and Classroom Membership account owners must follow applicable laws and institutional policies when arranging student registration and access.

Where parental consent or another legally valid authorization is required, the appropriate authorization must be obtained before the student's personal information is submitted.

A Classroom Membership does not, by itself, establish parental consent or authorize the collection of children's personal information.

Color Theory Education, LLC may establish additional account-registration requirements or restrictions for younger users to comply with applicable privacy obligations.

9.6 Classroom Account Management

Classroom Membership account owners may manage membership invitations, authorized users, and access permissions through available account-management features.

Invited members do not receive administrative authority over the Classroom Membership solely because they have been granted access.

Classroom account owners should protect invitation links and avoid disclosing student account information to unauthorized individuals.

9.7 Cookies and Related Technologies

Our websites and membership services may use cookies or similar technologies to support account authentication, security, website functionality, and other purposes described in our Privacy Policy.

Additional information about these technologies and available privacy choices will be provided in that policy.

9.8 Privacy Rights and Requests

Individuals may contact Color Theory Education, LLC with questions or requests concerning their personal information.

Requests will be reviewed and handled according to applicable privacy laws and the procedures described in our Privacy Policy.

Certain information may need to be retained for legitimate business, security, contractual, or legal purposes.

9.9 Personal Information, Limited Data Use, and Security

Color Theory Education, LLC respects the privacy of its members and is committed to limiting the collection and use of personal information.

We do not intentionally request, collect, or maintain personal information beyond what is reasonably necessary to establish, operate, support, and administer membership accounts and educational services, or to comply with applicable legal obligations.

We do not sell members' personal information or use membership registration information for unrelated marketing subscriptions without appropriate authorization.

Personal information necessary for account registration, authentication, subscription billing, and related services may be processed or stored through our authorized third-party service providers, including Memberstack and Stripe.

Color Theory Education, LLC does not directly store complete credit or debit card numbers.

We take reasonable measures to support account security and rely on appropriate technical safeguards provided by our service partners.

No internet-based service can guarantee absolute security. Members are responsible for protecting their account credentials and reporting suspected unauthorized access.

The Inclusive Color System (ICS) applications and related educational materials are provided for educational and creative purposes.

To the extent permitted by applicable law, the applications are provided on an "as available" basis, without guarantees of uninterrupted operation, error-free performance, or suitability for every user's particular educational requirements.

Nothing in these Terms & Conditions excludes warranties or consumer protections that cannot legally be waived.

10.2 Limitations of Liability

To the maximum extent permitted by applicable law, Color Theory Education, LLC, its owners, employees, and authorized service providers shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of, or inability to access, the ICS educational applications.

This includes, where legally permissible, losses associated with:

  • Internet service interruptions or inadequate connectivity.

  • Device or browser incompatibility.

  • Unauthorized access resulting from a member's failure to protect account credentials.

  • Interruptions involving independent third-party technology providers.

  • Loss of unsaved work caused by technical interruptions.

These limitations do not exclude liability that cannot legally be limited, including liability arising from conduct for which applicable law prohibits such exclusions.
